Condemnation, also called Eminent Domain, occurs when the government takes property for a public use. We have represented both governmental entities and property owners in condemnation matters. Public uses involve projects such as roads, public buildings, and utility installation. Governmental entities that engage in condemnation actions need to proceed according to proper legal processes. Property owners who face the loss of their property rights need to confirm that the government action has been properly authorized and that the proposed use is truly a public use, not a private use. Property owners are also entitled to fair compensation for property rights that are taken from them. The question of value is typically determined by expert witness appraisal testimony.
