Brad Gilmore has a wide-ranging general civil practice, with approximately 35 years of experience in civil litigation and other civil matters.  Though he limits his practice to civil cases and matters, his civil cases sometimes intersect with criminal cases and and the criminal justice system.  He has been involved in a wide variety of litigated and non-litigated matters since graduating from Vanderbilt University School of Law in 1989.  He became a partner in the firm in 1994.  

 

Mr. Gilmore moved to Nashville as a child and grew up here, attending Hillsboro High School. He then attended college at the University of Tennessee, Knoxville, graduating with high honors in 1986, with a major in history and a minor in math, after which he attended Vanderbilt Law School. He is married with three daughters.

In litigated matters, Mr. Gilmore represents clients in the areas of employment, tort and personal injury, insurance, premises liability, constitutional tort litigation, ERISA, professional liability, products liability, agribusiness, and construction defect litigation, among others. He has conducted numerous jury and bench trials, including but not limited to cases involving tort and personal injury, civil rights, employment discrimination, retaliatory discharge, and workers’ compensation.

Mr. Gilmore and the firm also serve as general counsel to the Clarksville, Tennessee Housing Authority, as well as other business and governmental entities.

Mr. Gilmore has held an AV rating (the highest available) from Martindale-Hubbell for legal ability and general ethical standards for many years.  Martindale-Hubbell is one of the most (if not the most) established peer-review ratings services in the nation.

Mr. Gilmore was selected for inclusion in Best Lawyers® 2025 (www.bestlawyers.com)in the category of Personal Injury Litigation--Defendants.

Representative cases and matters in recent years include but are not limited to the following (does not include pending cases or matters):

  • Recovered judgment in excess of $3.1 million on behalf of employee in retaliatory discharge action under T.C.A. Section 8-50-116 (whistleblower statute) following five-day bench trial and lengthy post-trial argument and briefing that spanned over one year after conclusion of proof.   

  • Obtained summary judgment for municipal defendant followed by defense verdict for individual defendant in federal jury trial involving allegations of excessive force arising out of use of police dog to apprehend suspect.

  • On behalf of decedent's employer, litigated complex maritime/admiralty issues in federal and state court in drowning case.

  • On behalf of dry ice supplier, litigated allegations of carbon dioxide suffocation from dry ice, causing death.

  • Litigated several trip-and-fall accident cases involving serious injuries and/or death and actual or alleged violations of codes and standards, including identification, retention, and management of expert witnesses on codes and standards alleged to have been violated.

  • Obtained summary dismissal of subcontractor and its principals in construction-defect case involving collapse of concrete masonry unit wall, based on statute of repose and service-of-process issues/defenses.

  • Represented employees of nightclub against allegations of assault on patron in case involving issues of spoliation of evidence, among others.

  • Litigated breach-of-warranty claim involving agricultural equipment (combine and corn and bean header).

  • Litigated complex construction-defect case in 4-day arbitration.

  • Represented plaintiff in construction defect arbitration hearing involving residential property.

  • Counseled and represented many employees regarding various employment-law matters, including but not limited to review of severance agreements, employment agreements, and executive compensation plans and related documents.

  • Participated in hearings and appeals regarding unemployment benefits.

  • Represented employee in contentious litigation involving, among other things, covenant not to compete.

  • Represented plaintiff in ERISA disability benefits case.

  • Represented numerous personal injury plaintiffs in litigation, including but not limited to motor vehicle accidents.

  • Represented victim of motorcyle accident in case involving catastrophic and life-altering injuries.  

  • Counseled clients regarding wrongful death litigation and claims.

  • Represented defendants in herbicide injury case involving claimed yield loss to corn.
